Talk to David

Privacy, Recording & Terms

Last updated: [DRAFT, date to be set at launch]

1. David is an AI character

"David" on this site is an artificial intelligence (AI) character inspired by Michelangelo's statue. David is an AI, not a real person. His voice is synthetic, and his answers are generated by software. They may contain mistakes, so please don't rely on them for factual, travel, medical, legal or financial decisions.

2. Consent to recording

Before a conversation starts, you must tick a box confirming that you understand the conversation will be recorded and may be used to improve the service. If you don't agree, don't start a conversation. By starting one, you consent to the recording of your voice and the conversation's content. You can end a conversation at any time.

[DRAFT: Some places, including several U.S. states such as California, require every party's consent to record. The checkbox is designed to get that consent. Confirm the required wording and any spoken in-call notice with counsel.]

3. What we collect and store

  • Audio recordings of your voice during a conversation.
  • Transcripts of the conversation, including David's replies.
  • Consent records: the time and date you ticked the recording box, and the version of this notice you accepted.
  • Your email address and name from checkout, used to send you a one-time thank-you email with the audio recording of your conversation.
  • Payment information: handled by our payment processor. We receive confirmation of payment, not your full card number.
  • Basic technical data such as device type, browser, approximate location from your IP address, and the length of the conversation.

4. How we use it

We use this information to provide the conversation, to process payments, to prevent abuse, to meet legal obligations, and to improve David's quality, accuracy and safety. After a paid conversation, we email the address you gave at checkout once, from a no-reply address, with a thank-you note and an MP3 audio recording of your conversation attached. Please keep that email private, since it contains your voice. We don't use your email for marketing. [DRAFT: State whether recordings are shared with the voice/AI provider, and whether they are used to train models.]

5. How long we keep it

[DRAFT: Set a retention period, for example recordings and transcripts deleted after 90 days unless needed for a dispute or by law.] You can ask us to delete your recordings at any time (see section 9).

6. Who we share it with

We share information only with service providers that help run Talk to David, such as hosting, AI voice, and payment providers, under contracts that protect it, or when required by law. We do not sell your personal information.

7. Age requirement

You must be 18 or older to use Talk to David. [DRAFT, owner decision needed: allow ages 13–17 with verified parental consent? Users under 13 are not allowed (U.S. COPPA). Allowing minors adds parental-consent and data obligations.]

8. Price and refunds

A conversation costs $3.99 (USD), charged before it starts. [DRAFT: Set the conversation length or time limit.] If a technical problem on our side stops your conversation from connecting or cuts it short, contact us and we'll refund you or give you a replacement session. Completed conversations are otherwise non-refundable, except where the law requires. [DRAFT: Confirm the refund window, for example 14 days, and EU/UK consumer-law withdrawal rules for digital services.]

9. Your choices and rights

Depending on where you live (for example the EU/UK under GDPR, or California under the CCPA/CPRA), you may have the right to access, correct, delete or get a copy of your data, and to object to certain uses. To make a request, contact us at [DRAFT: contact address to be added].

10. Acceptable use

Please be respectful. Don't use Talk to David for anything illegal, harmful, harassing or sexually explicit, and don't share sensitive personal information during a conversation. We may end conversations that break these rules.

11. Changes

We may update this notice. The version you accepted is recorded with your consent.
